The Village Ledger Privacy Policy

Introduction

The Village Ledger, LLC (“Company” or “We”) respect your privacy and are committed to protecting it through our compliance with this policy. Terms used but not defined herein shall have the meanings set forth in the applicable Terms of Service between you and the Company. This policy describes:

  • The types of information we may collect or that you or your business (collectively, “you”) may provide in connections with our websites and web portals (collectively, the “Site”), when you purchase, download, install, register with, access, or use the Village Ledger Mobile Application (the “App”) and other digital platforms that link to this Privacy Policy (together with the Site and App, the “Services”).

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in our Services and in email, text, and other electronic communications sent through or in connection with the Services.

This policy DOES NOT apply to information that:

  • We collect offline or on any websites you may access through this App.

  • You provide to or is collected by any third party, including, but not limited to, information provided to Checkr, the company we use for background checks of our Service Providers (“Background Checks”) or Stripe, the company we use for payment processing (see Third-Party Information Collection).

These other third parties have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Services. By downloading, registering with, or using this App, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Services after we revise this policy means you accept those changes, so please check the policy periodically for updates.

Children Under the Age of 18

The Services are not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at info@thevillageledger.com.

Information We Collect and How We Collect It

We collect information from and about users of our Services:

  • Directly from you when you provide it to us.

  • Automatically when you use the Services.

  • Through the results of your background check (if applicable)

Information You Provide to Us

When you download, register with, or use the Services, we may ask you to provide information by which you may be personally identified, such as:

  • Name
  • Business name;
  • Home postal address
  • Business postal address
  • Email address
  • Telephone number
  • Insurance policy information
  • Professional title and organizational affiliation; and
  • Other identifiers by which you may be contacted online or offline (“personal information”).

This information includes:

  • Profile and Registration Information that you provide by filling in forms in the Services. This includes information provided at the time of registering to use the App or Sites, subscribing to our service, posting material, and/or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the App. Examples of such information include username and password that you set to establish an online account with us, or age, gender, biographical details, photograph, links to your profiles on various third-party sites including social networks, and massage preferences including any health information you choose to provide

  • Communications that we exchange, including records and copies of your correspondence (including email addresses and phone numbers), if you contact us.

  • Identity data that we collect now or in the future to conduct identification verification and security checks (or in the case of Service Providers, background checks and other screens permitted by law), such as a social security number, tax identification number, passport number, state or local identification number, or professional license number, and an image of the relevant identification card.

  • Transactional data, such as the information needed to complete your orders and/or payments on or through the Services (including name, credit card information, bank account number, billing and shipping information, insurance information), and information about payments to and from you and other details of products or services you have purchased from us.

  • Marketing data, such as your preferences for receiving communications about our products, activities, events, and publications, and details about how you engage with our communications.

  • Other information that we may collect which is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection. Such as your responses to surveys that we might ask you to complete for research purposes and your search queries on the Services.

You may also provide information for publication or display (“Posted”) on public areas of the App or Sites or websites you access through the Services (collectively, “User Contributions”), such as Service Provider reviews. Your User Contributions are Posted and transmitted to others at your own risk. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Data from Other Sources

We obtain personal information from other sources, such as:

  1. Users, including Service Providers or Customers, who can provide ratings and feedback on their experiences through the Services.
  2. Screening providers, such as providers of background check, credit check, or other screening services.
  3. Data providers, such as information services and data licensors that provide demographic and other information
  4. Public sources, such as social media platforms.
Automatic Information Collection and Tracking

When you download, access, and/ or use the Services, the applicable Service may use technology to automatically collect:

  • Usage Details. When you access and use the Services, we may automatically collect certain details of your access to and use of the Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Services.

  • Device Information. We may collect information about your computer or mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.

  • Stored Information and Files. The Services also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

  • Online Activity Data. We may collect information about pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.

  • Location Information. The Services may collect real-time information about the location of your device.

If you do not want us to collect this information do not use the Services and do not download the App or delete it from your device. For more information, see Your Choices About Our Collection, Use, and Disclosure of Your Information. Note, however, that opting out of the Service’s collection of location information will disable its location-based features.

We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). See Your Choices About Our Collection, Use, and Disclosure of Your Information for information on how you can opt out of behavioral tracking on or through this app and how we respond to browser signals and other mechanisms that enable consumers to exercise choice about behavioral tracking.

Information Collection and Tracking Technologies

The technologies we use for automatic information collection may include:

  • Cookies, or mobile cookies. A cookie is a small file placed on your smartphone or website for the purpose of helping you navigate between pages efficiently and remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone or computer. However, if you select this setting you may be unable to access certain parts of our Services.

  • Web Beacons. Pages of the Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related Service statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

  • Software development kits, or SDKs. We may use SKS which are used to incorporate third party computer code into our Services that allows our third-party service providers or advertising partners to collect data directly from it for a variety of purposes, including to provide us with analytics regarding the use of the App, to integrate with social media, add features or functionality to our app, or to facilitate online advertising.

Third-Party Information Collection

When you use the Services or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

  • Advertisers, ad networks, and ad servers.

  • Analytics companies.

  • Your mobile device manufacturer.

  • Your mobile service provider.

  • The applicable app store in which you downloaded the App.

These third parties may use tracking technologies to collect information about you when you use this app. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the Service and its contents, and any other information, products or services that you request from us.

  • Operate and improve the Service and our business;

  • Conduct background checks and other screens permitted by law;

  • Establish and maintain your user profile on the Service, including allowing users to view profiles of Service Providers and Customers;

  • Process provider payments and related tax filings;

  • Enable security features of the Service, such as by sending you security codes via email or SMS, and remembering devices from which you have previously logged in;

  • Communicate with you about the Service, including by sending announcements, updates, security alerts, and support and administrative messages;

  • Fulfill any other purpose for which you provide it.

  • Give you notices about your account, including expiration and renewal notices.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it.

  • Suggest Services or Service Providers or Projects to Residents or Service Providers, as the case may be.

The usage information we collect helps us to improve our Services and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our App according to your individual interests.

  • Speed up your searches.

  • Recognize you when you use the App.

We may use location information we collect to help match Service Providers and Consumers and to share relevant content with you.

We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. If you do not want us to use your information in this way, please, see Your Choices About Our Collection, Use, and Disclosure of Your Information.

We may use the information we collect to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any, without restriction.

In addition, we may disclose personal information that we collect, or you provide:

  • To our subsidiaries and affiliates.

  • To contractors, service providers, professional advisors (such as lawyers) and other third parties we use to support our business.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of The Village Ledger, LLC’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by The Village Ledger, LLC about our App users is among the assets transferred.

  • To third parties to market their products or services to you if you have not opted out of these disclosures. For more information, see Your Choices About Our Collection, Use, and Disclosure of Your Information.

  • To fulfill the purpose for which you provide it. For example, if you provide us contact information for a Service Provider you wish to invite to the Service, we will transmit the contents and contact information of your invitation to the recipient.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

  • To provide Service Provider’s with the Project location and other Project and related Resident data. To tell Customers about Service Providers.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us, including the App EULA, Terms of Service, and Service Provider Agreement and for billing and collection.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.

  • Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device's location through the device’s privacy settings. If you block the use of location information, some parts of the App may become inaccessible or not function properly.

  • Opt-out of marketing communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email or the text message, as applicable, or by contacting us at info@thevillageledger.com. You may continue to receive service-related and other non-marketing emails.

  • Interest-based advertising. Some of our advertising partners are members of the Network Advertising Initiative (NAI) and are subject to the Self-Regulatory Principles for Online Behavioral Advertising published by the Digital Advertising Alliance (DAA). You can obtain more information about these companies' information collection practices and opt-out of receiving interest-based advertising from participating NAI and DAA members at http://www.networkadvertising.org/managing/opt_out.asp and/or the DAA's website at optout.aboutads.info. Mobile app users may opt out of receiving interest-based advertising in mobile apps provided by participating members of the Digital Advertising Alliance by installing the AppChoices mobile app, available at https://www.youradchoices.com/appchoices. You can also limit collection of your information for interest-based ads by blocking third party cookies in your browser settings or using privacy plug-ins or ad blocking software that help you block third party cookies. In addition, your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for targeted online advertising purposes. If you opt-out of interest-based advertisements, you will still see advertisements online, but they may be less relevant to you.

  • Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by sending us an email stating your request to info@thevillageledger.com.

  • Disclosure of Your Information for Third-Party Advertising and Marketing. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out by sending us an email stating your request to info@thevillageledger.com.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website.

Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the applicable Service and visiting your account profile page.

You may also send us an email at info@thevillageledger.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the App, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other App users. Proper access and use of information provided on the App, including User Contributions, is governed by our Terms of Service.

Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services like message boards. The information you share in public areas may be viewed by any user of the Service.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page with a notice that the privacy policy has been updated and notify you by either 1) email and/or text message to the primary email address or phone number specified in your account or 2) an in-App alert the first time you use the App after we make the change.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address and phone number for you and for periodically visiting this privacy policy to check for any changes.
